Erosion Control

I have had my share of problems in my neighborhood.  We had parts of a hill from a nearby development slide several times across our road.  The mud then goes down into the lake.  My neighbors and I had to fight hard with the county and call in the EPD to get resolution on what was a very clear case of man made erosion.

We are currently seeing an enormous shift in land prices. In the past, once grading started, the developer had every reason to comply with State and County environmental regulations.  So if a fine was issued the developer would fix the problem as soon as possible to keep his construction going.  Because of the lack of sales, some properties are falling into foreclosure.  Once that happens the developer won't fix any ongoing problems and fines can build up over time. The problem is that the runoff from those sites continues until the bank comes to realize that there is a problem.

I think this can be stopped if the county would contact the financial holder of the deed within a week or so of the fine being issued. Better yet, it bears investigating that there should be some kind of bond in place before a developer can start grading.
